GST Compliance
What is GST Compliance?
GST compliance refers to the process of fulfilling the legal requirements prescribed under the Central Goods and Services Tax (CGST) Act, 2017, the Integrated Goods and Services Tax (IGST) Act, 2017, the State Goods and Services Tax (SGST) Acts and the rules made thereunder. It includes obtaining GST registration, issuing tax invoices, maintaining prescribed records, filing GST returns, paying taxes on time and complying with other applicable GST provisions.
Why is GST compliance important?
GST compliance is important because it helps businesses meet their statutory obligations and ensure accurate tax reporting and payment. Timely compliance enables businesses to claim eligible input tax credit, avoid interest and penalties for non-compliance and maintain a good compliance record with the tax authorities.
It also improves business credibility, facilitates smooth audits and reduces the risk of litigation arising from incorrect invoicing, delayed return filing or tax underpayment.
How does GST compliance work?
GST compliance works by requiring businesses to fulfil various obligations throughout the GST lifecycle.
1. Obtaining GST registration
Businesses that meet the prescribed registration criteria or are otherwise liable to register obtain a GST registration and receive a Goods and Services Tax Identification Number (GSTIN).
2. Issuing tax invoices
The registered person issues GST-compliant tax invoices containing the prescribed particulars for every taxable supply of goods or services.
3. Maintaining records
The business maintains books of account, invoices, input tax credit records and other documents required under the GST provisions.
4. Filing GST returns
GST returns are filed within the prescribed due dates, reporting outward supplies, inward supplies, tax liability and eligible input tax credit.
5. Paying GST liability
The business pays the applicable GST after adjusting eligible input tax credit and discharges any remaining tax liability within the prescribed timelines.
6. Responding to notices and audits
Where applicable, the business responds to departmental notices, reconciles discrepancies and cooperates during GST audits, assessments or inspections.
Example
ABC Electronics is registered under GST and sells mobile phones across India. The business issues GST-compliant tax invoices for every sale, maintains records of purchases and sales, files its monthly GST returns within the prescribed due dates and pays its GST liability after claiming eligible input tax credit.
By completing these activities regularly, ABC Electronics remains compliant with the applicable GST provisions and avoids penalties for delayed filing or tax payment.
