Terms and Conditions
The scope of this program is to connect, educate and on-board the Book Keeping firms to promote their services on the digital platform which will add more power to their business. The platform enables the Book Keeping firms and their staff on the latest release of TallyPrime and list their business and their services on it and drives the business opportunity for them.
The platform mandates the Book Keeping firms to fulfil the following pre-requisites in order to be eligible to list their business on the platform:
Tally, at its sole discretion, may decide regarding listing of the Book Keepers subject to the fulfilment of above mentioned prerequisites and subject to satisfactory validation by Tally.
Mere submission of the interest by the Book Keepers, in any case, shall not be considered as their listing on the Platform.
The platform shall be used according with these Terms & Conditions, and you agree not to:
Upon termination, all copies of platform and related documentation shall be destroyed by the Book Keeper. Other provisions such as limitation and disclaimers shall survive the termination.
In no event shall Tally be liable for any special, incidental, punitive, direct or indirect or consequential damages whatsoever (including but not limited to damages for loss of profits, loss of confidential or other information, for business interruption, for loss of privacy, for failure to meet any obligation including of good faith or of reasonable care, negligence, and any other pecuniary or other loss whatever) arising out of or in any way related to the use of or inability to use the platform,or otherwise arising out of the use of the platform.
Tally expressly disclaim to the fullest extent permitted by law all representations, warranties, conditions, and guarantees, of any kind or nature whatsoever, whether express, implied, and statutory, including but not limited to any warranties, conditions, or guarantees relating to the platform of i) fitness for a particular purpose, (ii) of non-infringement of proprietary or intellectual property rights of any third party.
We reserve the right to modify these Terms and Conditions, at our sole discretion, at any time. Such modifications may be posted on our website Your continued access and utilisation of the platform indicates your agreement to the modifications.
This Agreement shall be governed by and construed in accordance with the laws of India .
In the event of dispute whatsoever arising between the parties in any way connected with the interpretation or implementation of any Terms & Conditions mentioned in this document, or in any way connected with the use or inability to use the platform, the same shall be referred to the sole arbitration or a person to be appointed by Tally, and the decision of the arbitrator will be final and binding on all parties. The arbitration proceedings shall always be held in the Republic of India. All disputes whatsoever that may arise shall be governed and construed in accordance with the laws prevailing in the Republic of India. By entering into this agreement and agreeing to arbitration, you agree that you and Tally are each waiving the right to file a lawsuit and the right to a trial by jury. In addition, you agree to waive the right to participate in a class action or litigate on a class-wide basis and you agree that you have expressly and knowingly waived these rights. The place of Jurisdiction shall be Bangalore, India.
These Terms & Conditions represents the complete and exclusive understanding between You and Tally regarding your use of platform and these Terms & Conditions shall supersedes any prior confirmation, advertising, representation, or other communication. If any provision of these Terms & Conditions is found to be void, invalid, or unenforceable, it shall be severed from and shall not affect the remainder of these Terms & Conditions, which shall remain valid and enforceable.
